We have a breadth and depth of knowledge and experience in nearly every aspect of real estate litigation. We represent developers, landlords, tenants, architects, investors, non-profits, and homeowners in disputes concerning: commercial leases; zoning, permitting, and land use; design and construction; and title issues, easements, adverse possession, boundary disputes, the partition of jointly owned properties and other issues. With our wealth of experience comes a deeper understanding of the particular pitfalls and priorities of real estate litigation.

+  Before the Court of Appeals, successfully defended the special permit for offices for a high-tech development in Kendall Square, Cambridge.

+  Successfully defended the zoning permits for a large, waterfront home on the South Shore.

+  Successfully defended the grandfathering rights for a homeowner in Hopkinton.

+  Successfully challenged the permits for a $10 million mansion on Cape Cod, winning in both the Trial Court and the Court of Appeals, resulting in an order that the mansion be torn down.

+  Obtained a successful settlement for a development consultant owed half a million dollars in fees for overseeing the acquisition, design, permitting, financing and leasing of his client’s real estate ventures.

+  Successfully represented buyers and sellers in disputes over the enforceability of offers to purchase and purchase and sale agreements.

+  Represented a homeowner in a retirement community in arbitration against the contractor who failed to properly construct his home.

+  Successfully represented several homeowners, businesses and non-profit conservation organizations in disputes over property boundaries, adverse possession and easements by prescription.

+  On several occasions, obtained successful settlements and judgments in Land Court, arbitration and mediation for individuals in “partition” actions – in which family members sued to end their joint ownership of real estate.
